Hi,

Can Someone tell me No. of leave entitled to employee in a year working in coprate sector under shops & establishment and other relevant act ?

Vibhash,

As per Bombay Shop and Establishment Act, 1948:

Every employee who has worked for not less than two hundred and forty days during a year (irrespective of the date of commencement of his services) shall be allowed leave, consecutive or otherwise, fro a period of not less than twenty-one days.

Shops and Establishments Act is not a central Act but each state has separate Act covering the shops and commercial establishments of the respective state. Post of Vibhash does not give any impression about the place where his company is situated. Under Kerala Shops and Commercial Establishments Act an employee who has been in the continuous service of 12 months shall get 12 days leave with wages. In addition to this, he will be eligible for 12 days sick leave. Similarly for sterilisation operation 6 days for men and 14 days for female are to be given.

Under Factories Act, those who have worked for 240 days in the preceding year shall be eligible for leave @ 1 day for every 20 days worked.

However, most of the corporates are having their own leave rules. The above rules are mandatory whereas there is no objection for better leave to employees. In order to increase morale most of the companies now have good leave patterns. It is better if leave is also made one of the conditions of employment and the same is specified in the Standing Orders of the company or in the appointment letter issued to the employee.
