Default bonus payment

Dear seniors,
please clarify the following:
1.According the recent amendment, the ceiling of elegibility is Rs.10000. If an employee drawing RS.9000 from April to December and drawing Rs.11000 from january to March, Is he elegible for bonus? My view is he is not elegible as he crossed the limit at the time of declaring bonus by the establishment. Am I correct?

Dear Ramchandran,

As per Bonus Act, the ceiling of eligibility is Rs 10 k Basic per month. According to your query, if a person is drawing Rs 9k from April to Dec , then his deduction would be at 3500 from April to dec.

From the period of Jan to March, his deduction would be again on 3500, but it would be termed as EX-GRATIA , becoz, the upper ceiling of bonus is Rs 10 k per month, and above 10 K AMOUNT would be termed as EX-GRATIA, though the calculation would be same as Bonus
