Hi,
An employee of our organisation has resigned and is ready to serve the complete notice eperiod i.e 2 mths, whereas his reporting officer wants to relieve him immediately.
Now this semployee is asking for the complete two months salary as he has no job in his hand.
Pls suggest what should be done in such a scenario.

The employee has honoured his obligations. If you want him to go immediately, you must pay him.

Hi Gunjan,
Usually, companies have a policy of "2months notice or salary in lieu of the notice period", when an employee is quitting the company.
Since the employee is willing to serve the notice period and you want him to leave early, you should pay him the 2months salary.

Hi Gunjan,
As deepthi said you need to pay him for two months because he is ready to server a notice period of two months. All these are already documented in the appointment letter.
An employer can avoid the chances of paying for notice period only if he is terminated not for his resignations...........

Dear Gunjan,
Please pay him.
I worked as a Manager with an MNC consulting at Hyderabad and wanted to serve notice period but was denied the same by management. Despite of my VP and DGM's commitment to pay me my two months salary, they refrained and denied any such promise and sent me a legal notice.
I know what I went through during next few months without job and income.
Sincere request - please pay him.

As a employee you have the full responsibilities in notice period so you have to pay two months salary ,on the notice period .

company must pay him two month's salary becoz he is not resigning from the company, company wants his resignation....................................... ....
so, company is responsible to give him two months salary

Hello Gunjan,
Your company has to pay the notice pay. It's a common practice and moral responsibility also.
Company can refuse to pay only in case of termination resulting out of misconduct where the legal obligations and police complaints are attached. In all the other matters company is bound to pay the notice pay...
" We shall also appreciate if you could also mention the reason for relieving an employee on immediate basis and also the reason for resignation. It will give more clarity to the entire seen."

Hi Gunjan,
The employee is willing to serve 2 months' notice period but the supervisor wants him to leave asap. Employee concerned should be paid 2 month's salary as he is willing to serve the notice period and not vice versa.
