Hi, Seasons Greetings! I was working for a private company in India whose Head Quarters are in Singapore. The promotors are basically Indians. I have just finished a tenure of one and half years with them. The company got into financial problems as there is no planning done properly even before i joined them which was not informed to me in prior.
They have not paid my full salary for 2 months. Later they have paid only 50% of my salaries in other two months. Company has made the employees to Sign the "salary cut acceptance letter" very Subsequently. All have signed it, some how! Later, they have revised (reduced) our salaries by 50% for a period of 6 months to 1 year. They had asked us to sign this letter too!
Now my request is, is there a possibility for me to get my
unpaid salary (though i have signed on salary cut acceptance letter - on company's letter head)? Please enlighten me on this so that, it will be a great help for me and my family. The total amt that is not being paid is really a big amount which runs into Lakhs of Rupees.
Two months back, the director asked me put down my papers as they dont want to terminate me (for the best reasons they know). As per my appointment letter, i am supposed to be given with 2 months notice period where as i was asked to move out in a months time. After that, i had no heart to attend to the office.
The company's laptop is with me even now and i have informed them repeatedly that i will return it once i get a job, as i am using it for searching a job.And i have no intentions to keep it (which i made it very clearly to them. Send them mails on this too). Now they are pestering me to give my resignation letter and ofcourse i have decided to return the laptop as i am not supposed to hold the company's property when i am not working for them.
I have signed acceptance letter on their letter head for the 2 months full salary cut and 50% cut for the next few months. Though they continued to cut my salary by 50%, they have failed to give me a letter or take my signature. They deducted 50% of my salary without my acceptance and approval. I am not paid something close to 6 lakh rupees. As a whole they cut close to rupees 30 lakhs across all the employees during this period.
We were informed that, they have taken this step as the company was not doing well then but now, they have got good business from good companies abroad and they have also started getting the payments from the clients. I heard, they are looking at acquiring a company too, now.
I have invested my good amount of time and money for this company. They promised us orally that, we are their core member team and we will be given with stock options/share options/share in profits and stuff like that.
Now, can any of you good souls suggest me on how to get my
unpaid salaries?
Should i have to send in my resignation letter?
Can i use the laptop for some more time?
