Do one thing, ask from the Labour Inspector, can you please provide me the for my knowledge that under which section of which Act it is so that I can take the format there and increase my knowledge.
Morever he can always check the payslip / Salary Register and verify the same. His purpose is something different, that I am very much sure.

| | I presume your said employee is on deputation with one of your clients and that client wants to produce a letter to the Labour Deptt. If so, you may try the format given below.
TO WHOMSOEVER IT MAY CONCERN
This is to certify that Mr. ……………………….., has been in the roll of this establishment since (date) Pursuant to a work arrangement, presently he is working with ……(client’s name) ……
This is also to certify that he is drawing a salary of Rs…. ( Amount more than Rs 10000)…….per month excluding employer’s contribution to Provident Fund or Pension Fund or contribution payable under Employees State Insurance, any traveling allowance or value of traveling concession, any special pay, Overtime pay or gratuity payable on discharge and is not covered by Employees State Insurance by virtue of clause (b) of sub section (iii) of section 9 of the Employees State Insurance Act.

you can give a letter stating :- this is to certify that Mr. s/o or D/O mr.& mrs__________ is employeed with us from _______ till date and his current gross salary is ___________.
As per Esic act 1948, employees drawing gross salary of 10000/- and above are exempted from contribution towards ESIC ,hence he exempted from the said act.
besides the above you can also attach a copy of salary sheet of the same where in his salary is mentioned along with his signature,a copy of returns filed.

| | Letter to prove exemption limit of ESI Dear Ditti,
For the proving of exemption of ESI is not manditory to produce infront of Client/labour inspector/any other statutory bodies,bz before asking the declaration from your end they should aware of the same.for that there is no need of submittin letter stating exemption of ESI.

Really it is strang one and also there is no need to show a letter regarding this. you can explain the ESI Act is given exemption for deducting ESI for employees who were having salary more than Rs.10000.

and even if the Labour inspector still asking for letter proof, you may show the Appointment letter or Incerement Letter, and also Payslip, salary certificate as said by rajeev. i think it is enough to him.

I understand that you depute your employee to a client who is covered under the ESI Act. If your assignment is purely of supply of manpower and in return u raise a bill on the basis of assignment/job performed by your personnel at client's place then you need to furnish the extract of salary sheet to the client for the period under contract. If you raise a bill on the no. of persons supplied to client place then your bill should indicate no. of persons rate per person, supervision fees etc. This record is to be maintained by client to show to the ESI inspector when come for inspection. I have my own doubt that only on the basis of your letter he will satisfy. |

There is no such letter to be given to anyone & there is no credibility of the letter format given above.
Salary Sheet & Salary Slip are the only docs. which are proff for ESI exemption.
If the Labour officer is demanding one, You may ask him to formally demand through a letter/notice, which he will not be able to issue.
