3. Though I will get job from other company but I want to expouse them for some extend.
4. I have contacted my lawyer and he will send a notice to them for the same.

But I want to check whether my case is strong to defend or not. If same management is saying that I am good in July-08 and appreciating my efforts and in Aug, they terminated me for which I have spent 4.3 year.

Can I file a FiR against my mangers for conspiracy against me to strong my case.

Please guide me.

Certainly there are several things you can do but all would prolong, however I' sceptical about the ultimate result if it may go in you favour.

Momentry you may have little relief, but the effort, physical/finnancial/mental you would put on, the result may not worth.

Still, I persue to consider all the aspect and then go ahead.

WHAT IF THE RESULT IS NOT WORTH ?

Think coolly, however you have lot of option.

People come across big calamities and loose all & then BUT WHAT DO THEY DO ? THINK ONCE AGAIN WITH COOL MIND, DO NOT GORGET TO TAKE YOUR PARENT INTO CONFIDENCE.

Best Wishes & Regards -

Hi All,
Today I met one good lawyer. He told me that as your appointment letter states that “This employment may terminated by either party by giving 2 months notice period” so you can’t fight for it and as IT companies don’t fall under labor law so it is another negative prospect for you. Though he will send a notice to them to know their course of action but I am not sure whether I will get anything from this.

Dear Sachi,
I am sure lot of my coleaugue has given you same advise. Neverthless, Such situation would arise in life cycle of all of us due to very nature of our job.
Do not get preturbed by such incident and move on. Probably thses are the test by which you identify good and bad organisation. The great name in the market does not make any organisation great.
This is a bad phase of your life bear it on and move to another dimension. Do let me know if i could be any help.

Though I got a good remark from my manager about my skill and team commitment towards my team/organization. On 25th Aug, they called me and asked me for resignation. When I asked the reason then they told me that I have some behavioural problem. I was just shocked and didn't sign the resignation letter. They proceeded with my terimnation.

They didn't send any written communication for my behaviour till 25th Aug 08.

I want to know that what action can I take against this well known IT company. They have put a false allegation for which they don't have valid proff.

Dear sachi

It is very difficult for an honest person to fight with a company.
Better way will be to fight against the wrong person of that company.
Openly mention the name of that person along with company name who is doing unjustice.
And leave the job with grace.
All the best.

Hi Sachi,

As suggested by our friends, it is important for you to leave the company with a good note, and find a good opportunity outside and get settled in your new workplace.
As i have read, you are also going through personal problems, hence this is not a right time to indulge into a fight with the company. Fighting at a wrong time is a wrong thing in itself. This will lead to more mental stress for you. Hence prioritize this event in your life and accept the offer given by your current company for 2 months paid leave and within that period find a good job. After you settle down in your new workplace and after your mother's health is good, you can take a sound decision of raising this incident legally.

My advice is " Don't worsen your condition more or invite more problems"

Not fighting against your rights is not cowardly act, but fighting at the wrong time is an incorrect one.

Default Face the problem

I had gone throught the majority of the mails, but here i find we ourself are developing the fear factor. Ultimately we are forgeting the true defination of HR where we self are the teacher in the organisation in developing good atmosphere. If we ouself feel, insecurity with this type of situation then i don't think we are worth for the position which we are holding. We are there to show number of person, direction, mission, and vision.

I agree if we accept this, are we not doing injustice to ourself (self-esteem). Future we should not feel sorry for what i could had done but not done.

Better we all get together and name the organisation where this type of harrassment are made and BLACK list them before the govt, media, our HR friends. I am sure majority of we are seeing/observing this type of situation either with ourself or (more) with other employee in the organisation. Lets us come out of the fear psychosis and face this type of situation.

With Regards

Hi Sachi,

At this time proceeding legally agnaist the employer is not advisable. If the Mangement say that you are teminated because of behaviour, First do the self analasys for their comments then go ahead for new job. Dont think of the past. Be strong. Once you are appriciated by the company then there is no defect in your performance. So be strong and go ahead for new job and prove yourself. Follow the leadership qulities from Mahabharatha.
