Default Leave

Dear Seniors,

I am working in an Engineering Consultancy firm. We are providing 15 PL and 12 days CL every year to our employees. These leave are not encashable.

We are trying to make a policy that in case an employee resigns, his complete leave balance will be lapsed and even not adjusted with the notice period, as he cannot take any leave during notice period. I want to know that would it be legally correct or there would be any legal obstructions????.

Please advise asap.

How many leaves should employees be provided in a year?

after resignation u can not laapse PL.these has to be encashed.
however CL is not encashable.

Thanks for the responses but want to know about the legal hurdles. Recently I came to know that there wont be any problem if we implement this policy.

dear
yes there is legal hurdle suppose i have resigned and u have not paid me amount of leave encashment .it is a loss to me and i can take help of court to recover this amount.
if u are travelling in train without ticket and no one caught u than u are safe and no problem and if TTE caught u than problems start.
till the time u are not caught for not following the law no probem.
