All the above posts relate to similar with the difference in amount of settlement. Before ariving at the amount payable please be informed that in all these cases the employees have left without intimation. In such situation it is better to issue a memo asking explanation for not reporting. If you are satisfied about the reasons for his not reporting or leaving the organisation without intimation, you can release the amount. If your company is so particular about the notice pay, you can deduct the amount from the amount due for final settlement and on the other hand, if your company is satisfied fully as to his leaving without notice, full settlement may be made without deduction also. It depends upon the policy of the company. But before full settlement ensure that there is no amount recoverable from him by way of advance, telephone, telephone bill etc.
Now, in these cases, since nobody has served for 5 years the question of gratuity will not arise. In the first two cases, the settlement shall be like this:
Gross Salary payable : 11400
EL encashment 6X 5000/26 : 1154
Total : 12554
In the third and fourth cases,
Salary : 9500.
EL : 0
Total : 9500.
