Default Annual leave during probation period

What happens if someone takes sick /annual leave during the probation period.

Employees are allowed to take certain sick-leaves during the probation period of six months. Normally, it is 1 days for every month.
Annual leaves are annual and can only be taken after the completion of one year with the organization.

Default Leave during probation

New joining Employee on probation are eligible for sick leave and casual leaves for unforseen events.

Annual leave which is known as Previleage Leaves (PL)or Earned Leaves or may its derived from the Factories Act provisions are acumulated on working days prorata basis. After finishing probation employee may apply for such leave or depending on circumstances and management confidence on employees, management may allow employee to avail in advance.

Thank you for your responses. One more query what happens to the staff who takes leave during probation period and either the employee leave company or is terminiated by the company within the probation period. Is he or she entitled for for leave benefit as she/he has not completed the probation. I have a clause in the Annual Leave policy that "Employees are not allowed to take leave during probation".

It is always better to stick to rules for prevention whic is better than cure. Because this will set wrong presedent and you will be in trouble. During probation no leave shall be allowed but he may be allowed Casual leave or sick leave if you have any such provision for such leaves other than Privileage or Earned Leaves.

I am totally agreeing with Mr. Sawant, During Probation period you can give Casual / Sick leave to an employee on pro-rata basis and the EL or PL can be availed by the Employee only after the completion of One year of service with the company.

dear all
i donot feel that as per factories act one year service is must to get earn leave.pls refer section 79(2) of factories act .
as per factories act an employee can not get any annual leave in the calender year he joins organisation.next year he will get leave accumulated in previous year.suppose one joins in sepetember 2008 in organisation ,he will be entitled for earn leave in jan 2009 pprovided he has worker more than two third working days in 2008.
it is a provision in factories act
if u have given advance earn leave and he has been terminated than also no problem u are not reqd to pay encashment for that leave otherwise u have to pay encashment.CL/sl no restriction.
