Default Contract Labour

Dear Friends,

My staff strength is 20 who are on the companies pay roll, but contract labour is around 70 through contractor. When I applied for contract labour licence the Labour commissioner put up the query that this is wrong as the staff strength should be more than the contract labour appointed. As contract labour is used only to tide the shortfall in manpower.

please could you suggest how to get out of this situation or what the LC. is saying is right.

Dear Friend,

Being employer you have to get yourself registered for the Contract labour. The licence will be taken by that contract who is supplying the labour, Contractor has to take the licence if the number of Contract Labour is more than 20, if you take 4 or 5 Contractor each having less than 20 nos. of Contract labour, than there is no requirement of the Licence.

The only thing required in that case will be the Registration of the Employer under the Contract Labour Act.

Thanks Rajeev,

I have got 2 contactors of 35 employees each. I have gone to get the registration for employers contract licence. This is where the L.C. has put this query.

Could you help ?

Hi Arnold,

The solution to your problem is not very acute.

As Rajeev rightly mentioned, you could hire 4 consultants each having a strength of 17 employee each. In this way you would avoid the tedious task of procuring an employers contract licence. Migrate / Divide your present staff among the 4 shortlisted consultants.

Should you find the need of applying to the Contract Labour Licence, then you would have to abide by what the LC says.

This you have to check that for what purpose you are taking the contract labour, whether that is allowed or not under the Contract labour Act.
