I was working with an educational institute and was associated for more than 6.5 years. I have left the organization on 1st May 2008. I was released and I am in the process of getting the PF. But the company has not cleared my Gratuity, Leave Encashment and some conveyance amount which totals to around Rs.1.5 lacs. How to approach and get the claim? Please help me in this regard. It was not mentioned in the company rule book that gratuity would be given to the employees. But I have completed 6.5 years of service there. Please help me in this regard.

Gratuity is a central act, it is applicable to all the industry having 10 or more person employed. If the employer is willingly not clearing your dues. Please make a full & final statement at your end and sent it through register AD. Hope this will work out.

Arup, As per arup guidelines Gratuity is applicable to all industry. After this u can go Labour Office with your Appointment Letter. They will take care. Regards,

Kindly provide me with the letter format as to how I would apply for a full and final settlement. Please send me the format as early as possible. You have only answered about gratuity, what about leave encashment and conveyance bills which are still unpaid? Please revert immediately. Please help me. Please send me a format (letter) on how to apply for a gratuity+leave encashment+conveyance so that i can submit the letter to my previous employer and also to the labour commissioner. My period of service can also be verified from the PF office, isn't it?
