Smile formulation of leave policies for the partnership firm

Dear all ,

I have recently joined an organisation which is a partnership firm . And the company is into the production of the Gen Sets . and I have been put into the corporate office which is in delhi . Here I have been told to formulate the hr policies for the company . I am the only person who has to set up the HR Deptt.My Boss is also very cooperative in all the matters .Here the number of employees are around 13-14 . they all are into the distribution of Gen Set. I am working on the leave policies these days. so my query is in the preparation of the leave policies what are factors I have to consider ? Or what will be the right way to move ahead ? what acts i have to consider in the making of policy ? Can I consider Factories Act ? Or is there any other act i have to take care of ? I have to make policies only for delhi corporate office at this point of time.

The rules are clear You can implement as it is

For Develop your leave policy.You have to consider Factory act rules regarding leave.so read it.But generally all indutries gives Casual,Sick and Privilege leaves .Also you have to consider your employer opinion regarding these leaves

For Earned Leave ........... you can take the reference of Factories Act.

For Casual and Sick Leaves............You can take the reference of SHop and Establishment Act.


For National Holidays................Take the reference of National Holiday and Festival Act.

Please do not break your Head too much.Just folllow the Shops &Establishments Act as already advised by M/S sivasankaran & Rajeev Verma .

Dear Hr Gurus,
Thank you so much to all of you for giving such valuable replies. But I am in a fix . As we are a partnership firm and we are into the production work also. So will it be ok to consider Delhi shops and establishment Act?

Dear all Hr gurus,
I am having the doubt regarding the CL/SL/PL accumulation . As per the shop and establishment act CL/SL can be accumulated till 25 in maximum beyond that it will lapse. what does it mean the all accumulated CL/SL will lapse or the extra leaves beyond the specified limit will lapse.

like If An Employee accumulate 30 CL/SL ,in that case all 30 leaves will lapse or only 5 leaves will lapse.
