Default Please Help Regarding Notice

Dear All seniors

Im an Hr Executive working with a pharam company.
I am handling their general HR activities.

My Company used to have a bpo and was registered under EPFO.
It was suddendly closed down after the death of the director last year aug 07.
Yesterday, i received a notice from Profession Tax office. FORM IV. a notice for a hearing on 5th June 08. "for failing to file the returns from 1/04/06 to 31/03/08"

My boss has given me the responsibility to take care of it.
Can anyone suggest me, What will be the correct procedure to handle this?

Please, help me. I am in a mess right now.

How come you have recd a notice on prof tax from EPFO?

Hi,

I am surprised about the same.

But barring that please reply to if you have formally closed the BPO by attaining the closure certificate. If not then you are liable to pay the fees mentioned. Though during the hearing you can mention about the shut down and they might reduce the amount.

Sir

Its Form IV "Notice of hearing to an employer under sub section (6)", in the name of the BPO.
They have mentioned the registration No.

And the period for which the return was't filed.

Hi Kulvir,

The best alternative you have is to confirm if you have formally shut down the BPO.

The fees due since 2006 will have to paid till the closing date.

In case you dont have the closure certificate then you will have to prove that your office was closed down and later they provide you with a solution of paying the minimal amount and some fine for obtaining the closure certificate.

Its better to take your accounts department head to the hearing.

He will be of better help, also take someone smart who can understand and speak the local dialect. Sometimes with the inspector that helps too.

In case you are not confident, consult your legal advisor, he would be the best person to provide you with a solution.

As well consult the person who takes care of your taxes with your accounts department head before going in for the meeting.
